Terms of Service

By accessing or using Pivot (“the Service”), available at pivot-cv.com, you agree to be bound by these Terms of Service (“Terms”). These Terms constitute a legally binding agreement between you (“you”, “your”, or “User”) and Pivot (“we”, “us”, or “our”).

If you do not agree with any part of these Terms, you must not access or use the Service. Your continued use of the Service following the posting of any changes to these Terms constitutes acceptance of those changes.

These Terms apply to all visitors, users, and others who access or use the Service. By using the Service, you also agree to our Privacy Policy, which describes how we collect, use, and protect your personal information. The Privacy Policy is incorporated into these Terms by reference.

You represent that you are at least 16 years of age and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms.

Pivot is an AI-powered CV and resume builder designed to help job seekers create professional, tailored resumes. The Service is provided as a web application and is available through both free and paid subscription tiers.

The Service includes, but is not limited to, the following features:

• AI-Assisted CV Creation: AI-powered tools that help you write, refine, and optimise your resume content, including professional summaries, work experience descriptions, and skills sections.
• Template Selection: A range of professionally designed CV templates that you can choose from and customise to suit your preferences and industry.
• PDF Export: The ability to export your completed CV as a professionally formatted PDF document suitable for job applications.
• PDF Import: The ability to import an existing CV from a PDF document, which is parsed using AI to extract your information and populate your Pivot profile.
• Job Market Research: AI-powered analysis of job market trends and requirements relevant to your target roles, helping you tailor your resume to current employer expectations.
• AI Chat: An interactive AI chat feature that assists you with resume-related questions, content suggestions, and career guidance during the CV building process.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to notify users of significant changes in advance. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

To access certain features of the Service, you must register for an account. When creating an account, you agree to the following:

• Accurate Information: You must provide accurate, current, and complete information during registration and keep your account information up to date. Providing false, misleading, or outdated information is a violation of these Terms and may result in the suspension or termination of your account.
• Credential Security: You are responsible for safeguarding your login credentials, including your password, and for any activity that occurs under your account. You must not share your account credentials with any other person. We recommend using a strong, unique password that you do not use for other services.
• Unauthorised Access: You must notify us immediately at [email protected] if you become aware of any unauthorised access to or use of your account. We will not be liable for any loss or damage arising from your failure to protect your account credentials.
• One Account Per Person: Each individual may only maintain one account. Creating multiple accounts to circumvent usage limits, abuse free tier benefits, or evade a suspension or ban is strictly prohibited and may result in the termination of all associated accounts.

Free Tier

Pivot offers a free tier that provides access to a limited set of features. The free tier is subject to usage limits, including restrictions on the number of templates available, AI interactions, and other features as described on our pricing page. We reserve the right to modify the features and limits available under the free tier at any time.

Pro Subscription

Pivot offers a Pro subscription that provides access to additional features and higher usage limits. The Pro subscription is available on both monthly and annual billing cycles. All payments are processed securely through Stripe, our third-party payment processor. We do not directly collect or store your full payment card details.

Auto-Renewal

Pro subscriptions automatically renew at the end of each billing period (monthly or annually, depending on the plan you selected) unless you cancel before the renewal date. You will be charged the then-current subscription fee at each renewal. We will attempt to notify you before any price increase takes effect on your next renewal.

Cancellation

You may cancel your Pro subscription at any time through your account settings. Upon cancellation, your subscription will remain active until the end of the current billing period. You will not be charged for subsequent billing periods after cancellation. When your subscription expires, your account will revert to the free tier and you will lose access to Pro-only features.

Refund Policy

If you are not satisfied with your Pro subscription, you may request a pro-rated refund within the first 14 days of your initial subscription purchase. Refund requests should be sent to [email protected]. After the 14-day period, or for subsequent renewal charges, no refunds will be issued. Refunds for annual subscriptions will be calculated on a pro-rated basis for the unused portion of the subscription term within the 14-day window.

Price Changes

We reserve the right to change our subscription prices at any time. If we change the pricing for your subscription, we will provide you with at least 30 days' advance notice via email or in-app notification before the new pricing takes effect. The new pricing will apply to your next billing cycle following the notice period. If you do not agree with the price change, you may cancel your subscription before the new price takes effect.

Pivot's AI features are powered by Anthropic Claude, a third-party large language model. AI is used throughout the Service to assist with content generation, resume writing, market research, and other features.

You acknowledge and agree to the following regarding AI-generated content:

• No Guarantee of Accuracy: Content generated by AI is not guaranteed to be accurate, complete, current, or error-free. AI models may produce content that contains factual inaccuracies, grammatical errors, or inappropriate suggestions.
• User Responsibility: You are solely responsible for reviewing, editing, and verifying all AI-generated content before using it in your CV or any other context. You should not rely on AI-generated content without independent verification.
• No Employment Guarantee: Pivot does not guarantee that using our Service or AI-generated content will result in job interviews, job offers, or employment. The effectiveness of a CV depends on many factors beyond the scope of our Service, including job market conditions, employer preferences, and your qualifications and experience.
• Content Ownership: You are responsible for ensuring that any AI-generated content you include in your CV is truthful and accurately represents your skills, experience, and qualifications. Submitting misleading or false information to potential employers is your sole responsibility.

We continuously work to improve the quality and accuracy of our AI features, but the nature of AI technology means that errors and imperfections are inherent. Use AI-generated content as a starting point and always apply your own judgement.

Your Content

You retain full ownership of all content you create, upload, or provide through the Service, including your CV content, personal information, work history, and any other data you submit (“Your Content”). Pivot does not claim any ownership rights over Your Content.

Limited Licence to Pivot

By using the Service, you grant Pivot a limited, non-exclusive, non-transferable, revocable licence to access, process, store, and display Your Content solely for the purpose of providing and improving the Service to you. This includes processing Your Content through the Anthropic Claude API to deliver AI-powered features. This licence terminates when you delete Your Content or your account.

Pivot's Intellectual Property

The Service, including but not limited to the website, web application, software, algorithms, user interface design, CV templates, branding, logos, graphics, documentation, and all other proprietary technology and materials (“Pivot's IP”), is and remains the exclusive property of Pivot and its licensors. Pivot's IP is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose in accordance with these Terms. You may not copy, modify, distribute, sell, lease, or create derivative works based on Pivot's IP without our prior written consent.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Illegal Content: Use the Service to create, store, or distribute content that is unlawful, defamatory, fraudulent, obscene, threatening, or otherwise objectionable, or that violates any applicable law or regulation.
• Automated Access: Use any automated means, including bots, scrapers, crawlers, or scripts, to access, monitor, or interact with the Service without our prior written consent. This includes automated scraping of content, templates, or any other data from the Service.
• Reverse Engineering: Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, underlying algorithms, or architecture of the Service or any part thereof.
• Security Circumvention: Attempt to circumvent, disable, or interfere with any security features, access controls, usage limits, or authentication mechanisms of the Service. This includes attempting to access features or data that you are not authorised to access.
• Malicious Code: Upload, transmit, or distribute any viruses, malware, trojans, worms, or other malicious code that could harm the Service, its infrastructure, or other users.
• Harassment & Discrimination: Use the Service to harass, threaten, intimidate, or discriminate against any individual or group based on race, ethnicity, gender, sexual orientation, religion, disability, age, or any other protected characteristic.
• Impersonation: Use the Service to create CVs that impersonate another person or misrepresent your identity or affiliations.
• Service Abuse: Use the Service in any manner that could overload, damage, disable, or impair our servers, networks, or infrastructure, or interfere with any other user's ability to use the Service.

We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates this section, including without limitation removing content, suspending or terminating accounts, and reporting violations to law enforcement authorities.

Termination by You

You may delete your account at any time through your account settings. Upon deletion, we will begin the process of permanently removing your personal information and CV content from our active systems. This deletion process will be completed within 30 days. Backups containing your data may persist for a limited period in accordance with our data retention practices, after which they will also be purged.

Termination by Pivot

We may suspend or terminate your account and access to the Service at any time if we reasonably believe that you have violated these Terms, engaged in fraudulent or abusive behaviour, or if required by law. Where possible, we will provide notice and an explanation for the suspension or termination. In cases of severe or repeated violations, we may terminate your account immediately without prior notice.

Data Export

Before deleting your account, we recommend that you export your CV data using the export features available within the Service. Once your account is deleted, we will not be able to recover your data. If your account is terminated by Pivot for a Terms violation, we will make reasonable efforts to allow you to export your data before deletion, unless doing so would compromise the security or integrity of the Service.

Effect of Termination

Upon termination, your right to use the Service will immediately cease. Any provisions of these Terms that by their nature should survive termination shall continue to apply, including but not limited to intellectual property provisions, limitation of liability, indemnification, and governing law.

To the maximum extent permitted by applicable law, you acknowledge and agree to the following:

“As Is” Provision

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, or statutory. We expressly disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

Liability Cap

In no event shall Pivot, its directors, employees, partners, agents, suppliers, or affiliates be liable for any amount exceeding the total fees paid by you to Pivot in the twelve (12) months immediately preceding the event giving rise to the claim. If you have not paid any fees to Pivot, our maximum aggregate liability shall not exceed fifty New Zealand dollars (NZD $50).

Exclusion of Damages

In no event shall Pivot be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, data, goodwill, business opportunities, or other intangible losses, arising out of or in connection with your use of, or inability to use, the Service, regardless of whether such damages are based on contract, tort, negligence, strict liability, or any other legal theory, and even if we have been advised of the possibility of such damages.

Employment Outcomes

Pivot is not liable for any employment outcomes, including but not limited to failure to obtain interviews, job offers, or employment. The Service is a tool to assist with CV creation and does not guarantee any specific result.

Jurisdictional Limitations

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability for incidental or consequential damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by applicable law. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, death, or personal injury caused by negligence.

These Terms shall be governed by and construed in accordance with the laws of New Zealand, without regard to its conflict of law provisions. Any legal action, suit, or proceeding arising out of or relating to these Terms or the Service shall be instituted exclusively in the courts of New Zealand, and you consent to the personal jurisdiction of such courts.

Before initiating any formal legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at [email protected]. We will make good-faith efforts to resolve any dispute through informal negotiation within 30 days from the date you contact us. If the dispute is not resolved through informal negotiation, either party may then proceed with formal legal proceedings in the appropriate New Zealand court.

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

We reserve the right to modify or replace these Terms at any time at our sole discretion. When we make changes, we will update the “Last updated” date at the top of this page.

For material changes that significantly affect your rights or obligations under these Terms, we will provide at least 30 days' advance notice before the changes take effect. We will notify you of material changes through one or more of the following methods:

• Sending a notification to the email address associated with your account
• Displaying a prominent notice within the Service, such as an in-app banner or notification

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree with the revised Terms, you must stop using the Service and, if applicable, cancel your subscription and delete your account before the changes take effect.

We encourage you to review these Terms periodically to stay informed about the rules governing your use of the Service. Non-material changes, such as typographical corrections or clarifications, may be made without prior notice.
